MTD SERVICES, INC. TERMS, POLICIES, AND WARRANTIES

Effective Date: February 1, 2025. This document outlines the general rates, policies, warranties, and terms and conditions for services provided by MTD Services, Inc. (“MTD,” “we,” or “us”). By engaging our services, you agree to these terms.

1. LABOR RATES AND CHARGES

Standard Labor Rates MTD charges for labor in 15-minute increments for time spent on work, including incomplete jobs or temporary fixes. Technician rates are $120.00 per hour, and helper rates are $70.00 per hour. Payment may be due daily based on your payment terms.

Travel Time Travel time is charged in 15-minute increments for travel from our last stop or shop to your location, picking up supplies or loading equipment for your job, returning to our shop after work (last job of the day or emergency calls), and leaving your site to obtain supplies and returning. As of February 1, 2025, fuel surcharges and tolls are no longer charged.

Overtime Labor Rates Regular hours are Monday–Friday, 8:00 AM to 4:30 PM. Work performed outside these hours (excluding holidays) may be charged at 1.5 times the standard labor rates.

Emergency and Holiday Labor Rates Emergency calls, including weekends, are charged at 1.5 times the standard rates with a 3-hour minimum. If a technician is pulled from another job during regular hours for an emergency, the 3-hour minimum applies. Holiday calls are charged at double the standard rates with a 3-hour minimum.

2. MATERIALS AND EQUIPMENT

MTD will charge for all materials and equipment used. Additional fees, such as environmental charges, freight, shipping, handling, and/or tariff surcharges may apply.

3. SCHEDULING AND CANCELLATION

Scheduling and ETA MTD strives to schedule service calls efficiently, but schedules may change due to emergencies or other priorities. We appreciate your patience as we aim to provide the best service possible.

Cancellation Policy To cancel a service request, you must email service@mtdservicesinc.com. Phone calls alone are not accepted for cancellations. If a technician has been dispatched or arrives before we receive your cancellation, you will be charged for the technician’s time.

4. WARRANTY POLICIES

Service Warranty MTD warrants service work against faulty workmanship for 90 days from the service date, as indicated on the service ticket or invoice.

Installation Warranty MTD warrants equipment installations against faulty workmanship for one year from the installation date. This warranty covers on-site labor to correct faulty workmanship only. It does not cover diagnosis, repair, or replacement of components not included in the original work.

Manufacturer Warranties All installed equipment and parts are covered by the manufacturer’s warranty, which governs the terms of coverage. Customers are responsible for costs not covered by the manufacturer’s warranty. If MTD installs replacement components to minimize downtime during a warranty claim, customers will be invoiced for all labor, materials, components, freight, shipping, and taxes. If the manufacturer approves the claim, MTD will issue credit (for accounts with an open A/R balance) or a refund by check for the approved amount.

Warranty Exclusions MTD’s warranties do not cover travel time, shop time, diagnostic time, or labor not covered by MTD’s or the manufacturer’s workmanship warranty. They also exclude materials, equipment, freight, taxes, or shipping costs not covered by applicable warranties, as well as wear items, normal maintenance, equipment modifications, accident damage, or improper use.

5. SPECIAL WARRANTY POLICY

This policy applies to all brands except Rotary and Forward and supplements but does not replace other warranty policies.

Parts MTD strives to ensure accuracy when ordering parts using model and serial numbers, manufacturer data, and customer service support. However, lift manufacturers may provide unreliable parts information, and fitment issues may not be identified until installation. Customers are responsible for additional costs arising from manufacturer-supplied parts, including labor, mobilization fees, freight, shipping, restocking charges, or other expenses. The parts manufacturer’s warranty will apply, and customers are responsible for costs not covered, such as diagnostic time, mobilization, freight, shipping, or labor.

Cylinder Rebuild or Resealing For cylinder repairs (instead of replacement), the Rebuilder’s Warranty applies. Customers are responsible for costs not covered, including diagnostic time, mobilization, freight, shipping, labor, or replacement fluid.

MTD Recommendations Based on our experience, MTD may recommend against certain repairs if they are impractical or not cost-effective. The final decision rests with the customer, and these terms apply.

5. PROPOSAL TERMS AND CONDITIONS

General Terms All materials are guaranteed to meet specified requirements, and work will be completed professionally per industry standards. Alterations or deviations from the original proposal resulting in additional costs require written approval and will be billed as extra charges. MTD is not responsible for delays caused by strikes, accidents, or other circumstances beyond our control. The property owner is responsible for obtaining fire, tornado, and other necessary insurance. MTD’s employees are fully covered by Workers’ Compensation Insurance. Invoice disputes must be submitted in writing via certified mail within 15 business days of the invoice date. A service charge of 18% per annum may apply to accounts overdue by more than 30 days. Past-due accounts may be referred to an attorney or collection agency, and customers are responsible for all legal fees, collection costs, and court expenses. Proposal pricing is valid for 15 days.

Lift Installation Exclusions Unless explicitly stated in the proposal or approved in writing by an authorized MTD representative, the property owner is responsible for obtaining all required permits. Electrical work is not included. Heavy-duty in-ground lifts require a 3-phase power supply. For lifts with air locks, the air supply must be within two feet of the piping run to the air lock switch. The new air line will be poly-flow type. Pipe taps and valves are not included and incur additional costs. Installation pricing assumes adequate clearances for unobstructed installation. Floors must be of sufficient thickness and strength, with no control joints or cracks at base plates, and level within standard shimming capability. Shim kits, if required, will be billed separately. Corrections to unsuitable conditions will result in additional charges. Work areas, including bays and staging areas, must be cleared before the installation crew arrives. Delays may result in crew holding charges. Upon installation, cables are adjusted per manufacturer recommendations. Cables may require further adjustment during regular use, which is considered routine maintenance (see owner’s manual). Cable tensioning is not covered by MTD’s or the manufacturer’s warranty and will be billed as a standard service call.

Lift Installation Clauses If excavation encounters rock, water, underground utilities, tree trunks, concrete rubble, excessive concrete, or other obstructions, additional work will be charged on a cost-plus basis. Environmental regulations requiring additional work (e.g., well installation, contaminated soil removal, special trucking) will incur separate charges. MTD is not liable for consequential damages. All materials and installation components remain MTD’s property until full payment is received. If an account becomes delinquent, MTD may repossess materials without notice. Customers are responsible for all installation, removal, and restocking fees related to repossession. MTD is not liable for consequential damages resulting from repossession.
